This
End User License Agreement accompanies the CastleLotto
software
product
and related explanatory materials ("Software"). The term "Software"
shall also include any upgrades, modified versions,
updates,
additions and copies of the
Software
licensed to you by Castle Software Ltd. "You"
means the person or company who is being licensed to use the Software or Documentation.
"We" and "us" means Castle Software Ltd.
Please read the terms of this license agreement carefully before installing
or using this software. This End
User License Agreement (the Agreement) is a legal agreement between you (Licensee),
the end-user and Castle Software Ltd and by using this software or storing this
software on a computer hard drive (or other media), you are agreeing to be bound
by the terms of this Agreement. Castle
Software Ltd will license the software to you only upon all of the terms contained
in this license agreement. If you do not agree to these terms, you should not
install this software.

The Software is owned by Castle Software Ltd and its structure, organization and code are the valuable trade secrets of Castle Software Ltd. This Software is a copyrighted work and is protected by copyright law and international treaties.
This Software product is licensed, not sold. It is, and shall remain at all times, the absolute and unrestricted property of Castle Software Ltd. Nothing in this Agreement shall prejudice, impair, jeopardize or otherwise adversely affect the rights of Castle Software Ltd as sole and exclusive owner of the Software.
CASTLE
SOFTWARE LTD RESERVES THE RIGHT TO MODIFY THE SOFTWARE AND ASSOCIATED DOCUMENTATION
AT ANY TIME WITHOUT OBLIGATION TO NOTIFY ANY PERSONS OR PARTIES OF SUCH MODIFICATIONS.
This
is not free software.
This Software is distributed as Shareware and as such you may use the
software without charge for evaluation purposes for a non-renewable trial period
of fifteen (15) days.
At the end of this 15-day evaluation period you must immediately discontinue
use of the Software or pay a registration fee to Castle Software Ltd (See Registering
for details on purchasing a registered copy of the software).
When payment is received you will either be sent a license key to unlock
CastleLotto or be led to a download page to download a full registered version
of CastleLotto.
Unregistered use of CastleLotto after the 15-day evaluation period is
in violation of international copyright laws and treaties.
The cost of the Software has been kept low and you can easily register it on-line,
or by mail.
Upon
payment
of the registration fee and your
acceptance of this Agreement, Castle Software Ltd grants you
a nonexclusive license to use one copy of the Software on any single computer,
provided the Software is in use on only one computer at any time. The Software
is "in use" on a computer when it is loaded into temporary memory
(RAM) or installed into the permanent memory of a computer--for example, a hard
disk, CD-ROM or other storage device.
UNDER NO CIRCUMSTANCES ARE YOU LICENSED TO DISTRIBUTE THE REGISTERED VERSION
OF CastleLotto OR TO DISTRIBUTE LICENSE KEYS OR REGISTRATION DETAILS BY ANY
MEANS.
You
may make one copy of the software solely for backup or archival purposes or
transfer the software to a single hard disk drive, provided that you keep the
original software program and accompanying documentation in your possession,
solely for backup or archival purposes.
You
may transfer all your rights to use the Software and Documentation to another
person or legal entity provided you transfer this Agreement, the Software and
Documentation, including all copies, updates and prior versions to such person
or entity and that you retain no copies, including copies stored on computer.
Upon such a transfer, the previous owner of the end user license agrees
that his rights to such license are terminated and that he will immediately
discontinue using the Software.
Only
the shareware version of CastleLotto may be freely distributed, provided that
you follow the following conditions. Distribution
or lending of registered versions of CastleLotto or any registration details
is strictly prohibited and in violation of international copyright laws.
Provided that you verify that you are distributing the Shareware Version
you are hereby licensed to make as many copies of the Shareware version of this
software and documentation as you wish; give exact copies of the original Shareware
version to anyone; and distribute the software and documentation in its unmodified
form via electronic means. There is no charge for any of the above. The shareware version of CastleLotto can be obtained from the
CastleLotto web site (http://www.CastleLotto.com).
You are specifically prohibited from
charging, or requesting donations, for any such copies, however made; and from
distributing the software and/or documentation with other products (commercial
or otherwise) without prior written permission, with one exception: Magazines
or other press publishing companies that may include free CD-ROMs with their
publications are permitted to redistribute a shareware version of CastleLotto
subject to the conditions in this license, without specific written permission.
Nothing in this Agreement shall confer upon you the right to grant user
licenses. Such right is, and shall remain at all times, exclusively vested in
Castle Software Ltd.
You
may
not modify, adapt, translate, reverse engineer, decompile, disassemble or otherwise
reduce this software to a human perceivable form or
attempt to discover the source code of the Software.
You may not publicize, disclose
or distribute any registration code algorithms, information, registration codes
or license key files used by this software without permission of Castle Software
Ltd
CASTLE
SOFTWARE LTD EXPRESSLY DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS, EXPRESS
OR IMPLIED, WITH RESPECT TO THIS SOFTWARE.
THIS SOFTWARE AND THE ACCOMPANYING FILES ARE DISTRIBUTED "AS IS" AND
WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY OTHER WARRANTIES
WHETHER EXPRESSED OR IMPLIED.
BECAUSE OF THE VARIOUS HARDWARE AND SOFTWARE ENVIRONMENTS INTO WHICH
THE SOFTWARE MAY BE OUT, NO WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE IS
OFFERED.
IN NO EVENT WILL CASTLE
SOFTWARE LTD BE LIABLE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF THE USE OF
OR INABILITY TO USE THE SOFTWARE OR DOCUMENTATION, EVEN IF CASTLE SOFTWARE LTD
IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EXCLUSION FROM LIABILITY
INCLUDES, BUT IS NOT LIMITED TO, LOST PROFITS, LOST SAVINGS, BUSINESS
INTERRUPTION, LOSS OF BUSINESS INFORMATION OR ANY OTHER DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
IN NO EVENT SHALL CASTLE SOFTWARE LTD'S LIABILITY EXCEED THE PURCHASE
PRICE PAID (IF ANY) FOR THE SOFTWARE AND DOCUMENTATION.
GOOD DATA PROCESSING PROCEDURE DICTATES
THAT ANY PROGRAM BE THOROUGHLY TESTED WITH NON-CRITICAL DATA BEFORE RELYING
ON IT. THE USER MUST ASSUME THE ENTIRE RISK OF USING THE PROGRAM. ANY LIABILITY
OF THE SELLER WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF
PURCHASE PRICE.
This
license agreement shall be construed in accordance with and governed by the
law of New Zealand and the parties agree to the jurisdiction of the New Zealand
Courts.
